Privacy policy
What we collect, why we collect it, and what we do with it. Yours and your customers'.
1. Who this covers
This policy explains how Cushy Digital (ABN 00 000 000 000), trading as Cushy Digital, handles personal information. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
It covers two groups of people: our customers, meaning the trade businesses who subscribe, and our customers' customers, meaning the people who enquire with those businesses and receive a reply through the service.
2. What we collect about you, our customer
Your name, business name, ABN, email address, phone number and billing details. Details of the channels we connect to, such as your phone number, calendar and website forms. The words and tone you give us so we can write replies that sound like you. Records of your account, support requests and monthly reports.
Payment card details go directly to Stripe. We do not see or store them.
3. What we collect about the people who enquire with you
When someone calls, texts or submits a form to your business, the service may collect their phone number, name, email address if they give it, the content of their messages with the service, the time of each message, and details of the job they are enquiring about, such as the type of work and the suburb.
We collect this on your behalf so we can reply to them and book the job. We do not use it to market anything of our own, and we do not sell it.
4. Why we use it
To provide and run the service. To reply to enquiries and make bookings on your behalf. To measure and report response times, including for the 60-second guarantee. To bill you. To support you and improve how the service works. To meet our legal obligations.
5. Who we share it with
We use third parties to run the service. Depending on your setup these can include a telecommunications and messaging provider to send and receive calls and texts, an AI language model provider to draft replies, Stripe for payments, a calendar provider to place bookings, and hosting and analytics providers.
We share only what those providers need. We do not sell personal information, and we do not disclose it for anyone else's marketing.
We may disclose information where the law requires it, or to protect our rights or someone's safety.
6. Where it is stored
We host in Australia where we can. Some of our providers store or process data overseas, including in the United States. Where that happens we take reasonable steps to ensure the provider handles the information consistently with the Australian Privacy Principles.
7. Text messages and consent
The service replies to people who have contacted your business first. Every message identifies the business it is sent for, and every thread carries an opt-out that works immediately.
If someone opts out, the service stops messaging them. We keep a record of the opt-out so it is not undone by a later import.
8. Keeping it secure
We use access controls, encryption in transit, and reputable providers. No system is perfectly secure, but we take reasonable steps to protect information from misuse, loss and unauthorised access.
If a data breach happens that is likely to cause serious harm, we will notify affected people and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.
9. How long we keep it
We keep account information while you are a customer and for seven years afterwards where tax and business records require it. We keep enquiry and conversation records for 90 days after your subscription ends, then delete or de-identify them unless the law requires otherwise.
10. Getting access, or correcting it
You can ask us for the personal information we hold about you and ask us to correct it. Email hello@cushydigital.com and we will respond within 30 days. If we refuse, we will tell you why.
If you are someone who enquired with one of our customers and you want your information accessed, corrected or deleted, contact that business, or email us and we will pass it on and help.
11. Cookies
Our website uses only what is needed to run the site and understand basic traffic. We do not run advertising trackers.
12. Complaints
If you think we have mishandled your personal information, email hello@cushydigital.com and we will investigate and respond within 30 days.
If you are not satisfied with our response you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
